Manifest with Stefani provides the Manifest Your Soulmate Program, helping single people become more confident as an individual by undertaking activities to learn more about their own values, beliefs, thoughts, habits and improving their communication and goal-setting skills.

Parties
This Course Terms and Conditions (the “Agreement”) is a legally binding contract between you (the “Participant”) and S DE WITT RYALL PTY LTD ABN 62666783615 trading as Manifest With Stefani. It covers the purchase and delivery of your selected Course.

You are deemed to have read and accepted the Terms and Conditions contained in this Agreement upon receipt by you via email or through our website, AND by continuing to accept and engage the services provided by Stephanie De Witt Ryall.

MANIFEST YOUR SOULMATE TERMS AND CONDITIONS

TERM
1.1 This Agreement will begin upon payment of the advertised Course fees.
1.2 It will apply for the duration of the Course and completion of any payment plan going beyond the Course’s length.
COURSES
Stephanie De Witt Ryall provides the following services and programs:

COURSE FEES
3.1 You understand and agree:
Payment options for the Courses are as follows:
3.1.1 Full payment of the advertised Course fee at the time of enrolment.
3.1.2 All fees are in Australian Dollars and inclusive of GST.
3.1.3 Payment is accepted online by credit card.
3.2 DISCOUNTS AND SPECIAL OFFERS
3.2.1 The Courses may be offered at time-limited early bird pricing from time to time.
3.3 LATE PAYMENTS
3.3.1 You are responsible for ensuring required payments are made on time.
3.3.2 Stephanie De Witt Ryall reserves the right to cease Course access until the due fees are paid.
3.3.3 If an account is beyond 30-days overdue, Stephanie De Witt Ryall reserves the right to turn the account to third-party collections.
3.3.4 This Agreement will be terminated, and access to the Course will be revoked.
3.4 VARIATION
3.4.1 Pricing is valid for the term of the Agreement.
3.4.2 Stephanie De Witt Ryall reserves the right to vary any fees.
3.4.3 Changes in fees will not affect you and will only apply to a new round of Course delivery.
COURSE DELIVERY
You understand and agree:
4.1 All Courses will be delivered within the agreed time frame contained in the selected Course package.
4.2 Courses will be delivered via Thinkific and Zoom
4.3 All Courses must be booked and completed within the agreed timeframe.
REFUND POLICY
You understand and agree:
5.1 Requests for refunds are considered on a case-by-case basis and may be offered at Stephanie De Witt Ryall discretion entirely.
5.2 All refund requests must be made in writing to Stephanie De Witt Ryall detailing the reason for your request within 60 days of purchase of a Course.
5.3 You must submit all module workings for all listed activities, journal prompts and share your reason for refund. Without this, a refund will not be considered.
5.4 No refund is available after 61 days from the purchase of any Course.
5.5 Refunds will not be considered or issued for a change of mind.
5.6 You remain liable for the remainder of the Program fee regardless of whether you paid in full or by payment plan.

Refund Management
You understand and agree:
5.7 Your commitment to your success and completion of your Course is required to gain maximum results.
5.8 Refund requests after 61 days of the Course’s commencement will be managed according to our obligations and your rights as consumers under Australian Consumer Law.
5.9 Where your payment method is via a payment plan, costs will be calculated and deducted from the total fees owing to Stephanie De Witt Ryall.
5.10 You will remain liable for the balance for payment owed to Stephanie De Witt Ryall.
5.11 Failure to pay at any time is a breach of this Agreement, and we are entitled to seek legal relief and remedy for this breach and recover the debt owed by you.
5.12 Outstanding accounts will be referred to a third party for debt collection.
YOUR OBLIGATIONS
6.1 Your commitment includes but is not limited to:
● completing all modules in the Course
● attending all weekly live sessions and workshops
● completing, learning, doing, and sharing activities
● emailing Stephanie De Witt Ryall at hello@manifestwithstefani.com.au if any concerns arise

6.2 The Site, which hosts all programs and resource materials, can only be accessed by Participants.
6.3 You will respect the confidentiality of Stephanie De Witt Ryall and other Participants in all correspondence.
Technology issues
6.4 If there are any problems with the Site or if the host or network should go down due to circumstances beyond our control, S DE WITT RYALL PTY LTD ABN 62666783615 trading as Manifest With Stefani shall not be held responsible. However, we will do our best to get the system back up as soon as possible when it is within our control.
6.5 S DE WITT RYALL PTY LTD ABN 62666783615 trading as Manifest With Stefani shall not be liable to you or any other party because of viruses or malware that may infect your electronic equipment.
6.6 You agree that you:
a. will not use any robot, spider or other devices, process or means to access the Course;
b. will not compromise or circumvent the security controls of the Course or otherwise gain unauthorised access to the Course; and
c. will not attempt to interfere with the proper working of the Course.
Program Dashboard
6.7 You will be required to register your details to create a password to access the Course’s Dashboard’s program content.
6.8 Your login details will be shared to the email address provided at registration.
6.9 It is your responsibility to ensure the details you provide are correct and current.
Password security
6.10 You are solely responsible for the protection and confidentiality of any password that you may have issued to or subscribed for from time to time.
6.11 You will not share your password with any other person.
6.12 You will immediately notify us if your password is lost or becomes known to any other person.
6.13 You are solely responsible for accessing and using this Site via your password, whether such access or use is by you or any other person.
6.14 The personal information you provide to the Course will be managed according to our Privacy Policy.

INTELLECTUAL PROPERTY AND COPYRIGHT
7.1 All material on this Site or otherwise delivered by Stephanie De Witt Ryall including hard copy resources, PDFs, books and digital downloads (“Content”), is subject to copyright.
7.2 Modifying our content for any other purpose violates our copyright and other proprietary rights and is strictly prohibited.
7.3 You acknowledge that you do not acquire any ownership rights by using the Site or our Content.
7.4 The trademarks, logos, and service marks displayed on our Site are the registered or unregistered trademarks of Stephanie De Witt Ryall.
7.5 Whether registered or unregistered, the trademarks may not be used in connection with any product or service that does not belong to Stephanie De Witt Ryall ,in any manner that is likely to cause confusion with customers, or in any manner that disparages Stephanie De Witt Ryall,
7.6 As a Participant, you are bound, at all times, to ensure that you do not breach our intellectual property rights at any time for any reason.
7.7 You may not use any of the materials available in the Course or any teaching platform or in a manner that infringes on our rights or has not been expressly authorised by us.
7.8 All material, including but not limited to videos, call recordings, resource downloads, and templates available in the Course and within any program created by Stephanie De Witt Ryall, is provided solely for your personal and non-commercial use.
Use by licence only
7.9 Use of materials for any other commercial purpose is prohibited without the express written permission of Stephanie De Witt Ryall.
7.10 You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material the Course or related programs without the express permission of Stephanie De Witt Ryall. You may request such permission by emailing hello@manifestwithstefani.com.au
ACKNOWLEDGMENT AND DISCLAIMER
You understand and agree:
8.1 The goal of the Course is to guide you in personal-development, and help you feel more confident in order to attract your soulmate.
8.2 Stephanie De Witt Ryall cannot guarantee your ability to get results or improvements with your skills or otherwise with the course content, tools, ideas, information, or strategies provided.
8.3 Results are dependent on various factors, including but not limited to your commitment, personal ability, and dedication, and are in no way dependent on any information or training provided to you by Stephanie De Witt Ryall.
8.4 You have purchased the Course and engaged Stephanie De Witt Ryall’s services at your own risk.
8.5 All content, resources, and training are solely provided for personal use and information.
8.6 Stephanie De Witt Ryall does not offer any representations, warranties, or guarantees, verbally or in writing, regarding your results from the Courses.
8.7 Stephanie De Witt Ryall provides education, training, support, guidance, and tools, but any decision you make and the consequences that flow from such decisions are your sole responsibility.

9 LIMITATION OF LIABILITY

You understand and agree:
9.1 Liability for the services provided by the Course Creator is governed solely by the Australian Consumer Law and these Terms and Conditions.
9.2 Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.
9.3 Stephanie De Witt Ryall guarantees all courses are supplied to you with due care and skill and fit for the purpose that the services have been advertised.

10 GOVERNING LAW
You understand and agree:
10.1 The Terms and Conditions of this Agreement are governed and construed in accordance with the laws of the State of Queensland.
10.2 Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the State of Queensland.

I have read and agree to the terms and conditions of this Agreement and by continuing with the purchase of this Course I understand that I am legally bound by this contract.

COACHING TERMS AND CONDITIONS

TERM

COACHING SERVICE

4.2 Coaching Services will be delivered via Zoom

4.3 All Coaching Services must be booked and completed within 12 months from purchase date.

REFUND POLICY

You understand and agree:

5.1 Requests for refunds are considered on a case-by-case basis and may be offered at Stephanie De Witt Ryall discretion entirely.

5.2 All refund requests must be made in writing to Stephanie De Witt Ryall detailing the reason for your request within 7 days of purchase of a Coaching Service.

5.4 No refund is available after 8 days from the purchase of any Coaching Service.

5.5 Refunds will not be considered or issued for a change of mind.

5.6 You remain liable for the remainder of the Coaching Service fee regardless of whether you paid in full or by payment plan.

COACHING SERVICES AGREEMENT

Services
• I understand that Stephanie De Witt Ryall of Manifest With Stefani will provide me with holistic life and mindset coaching which will take place at an agreed upon time via Zoom.
• The coaching sessions will have a duration of 60 minutes.
• I understand prior to my first session, I need to return this form.
• I understand that the role of a holistic coach is to act as a supportive guide during the coaching process. The results that will stem from each session will depend entirely on the responsibility of me taking action on our agreed steps forward to create the changes I desire.
• If at any time I have a concern about the coaching experience, I agree to raise it with my coach in the first instance, either verbally or in writing. I understand that my coach requires honest communication in order to provide me with a speedy resolution.

PAYMENTS
• I understand that payment must be made in full and that no refunds are allowed for change of mind.
• I understand that all sessions and packages have a 12-month expiry from the date of purchase.

CANCELLATION/RESCHEDULING
• I understand I must give a minimum of 6 hours’ notice if I need to reschedule our session by emailing hello@manifestwithstefani.com.au
• I understand that if I fail to notify my coach in this timeframe that I will be charged 100% of the session fee.

SCOPE OF PRACTICE
• I understand that coaching is not therapy, counselling, or consulting and that my coach may suggest a referral where my needs are beyond their scope of practice as a coach.
• I understand that my coach is not a physician and therefore does not diagnose or treat disease, and that my sessions are not a substitute for diagnosis or treatment from a qualified health practitioner for illnesses, injuries, or other medical conditions.

CONFIDENTIALITY/CLIENT RIGHTS
• I understand that anything said or revealed in the sessions between coach and client is privileged information and will not be disclosed to any outside party. The exception is if the information revealed includes disclosure of illegal, unethical, or criminal activities.
• I understand that my coach may release information if subpoenaed or otherwise legally obligated, or reasonably allowed to do so, including circumstances where there is clear and imminent danger to myself or another person.
• I understand that my confidential personal file is kept in a secure location and is retained for 5 years after my coaching services cease, after which time all information will be destroyed in a proper manner.
• I understand that I may instruct my coach to release information to other health care practitioners in writing if necessary.

Acknowledgement
• I have read and understand the above disclosure regarding the services offered by Stephanie De Witt Ryall.
• I understand that they not a licensed physician and that their services are not licensed by the state of Queensland. I understand it is my responsibility to maintain a relationship for myself with a medical doctor, if I so desire. I further understand that the above named is not trained to diagnose illness, make recommendations involving pharmaceutical drugs or surgery, or handle medical emergencies.
• I have read and understand the above disclosure regarding privacy policies and confidentiality, and that experiences during these sessions are confidential, but subject to the usual exceptions governed by laws of the state of Queensland and other federal laws and regulations.
• Except in the case of gross negligence or malpractice, I or my representative(s) agree to fully release and hold harmless Stephanie De Witt Ryall from and against any and all claims, or liability of whatsoever kind, or nature arising out of or in connection with, my session(s).
• I have read and discussed the above information Stephanie. I understand the responsibilities and benefits of holistic life and mindset coaching, the nature and limits of confidentiality, and what is expected of me as a client of this service.
